Model Tenancy Act Related Doubt

I have filed a case in civil court in UP on 20 April 2021 and model tenancy act was approved on 06 April 2021. Since my case was filed after this tenancy act was approved opposite party gave an application in court that my case can't be fought in a civil court and should be governed by rent authority. Should in this case I should take my case back and put the application under this new law. Also in my district rent authority is still not appointed.
