My ex-partner and i have a child, aged below 5 years. We are not married, and the child lives with her. My name is on the child's birth certificate as the father. Can i, as the father, claim Joint Custody or any other Legal Rights over the child?

A.Dear Client
With live-in relationships getting legally recognized you and your partner should be considered equivalent to married couples and hence you shall get all the rights in the child as a father would have. Its a different matter that to exercise those rights you might have to knock the door of the courts.

Sir, also, her family insists on changing the childs name to another one, and they used this name in the childs Religious Certificate. This is different from the childs name on the Birth Certificate, where my name is also written as the father. What is the legal name of the child in the Court of Law, the one on the Birth Certificate or Religious Certificate?. Can my ex-partner and her family change the childs name on the Birth Certificate without my consent?. Will it affect my chances of getting a shared custody rights in court ?

A.Hello Sir,
Single fathers are generally not granted primary physical custody of children when the mother is deemed a good parent. But if he is having his name as father in Child's birth certificate then by securing his parental rights, however, the father may then be able to set up a legally binding shared custody arrangement or visitation schedule with Child's mother.

Sir, do i have a chance at getting a Shared Custody right of the child, we lived together for roughly around 3 months ?
