Ownership of agricultural land

One of My mother's brother ran away from home some 30 years ago and is still missing now my mother wants to claim the ancestral agriculture land which was on his name there was no will and her father died a long time ago too so how can she claim her right on it.

Under Section 108 of the Indian Evidence Act, 1872, a missing individual for over seven years is assumed dead. You may need to legally move the court to prove that such person has been missing for 30 years and all efforts have been taken to trace his being in order to acquire his property.
