A.Dear Sir,
Your last idea is better and if you go to Canada without informing then it is very difficult for them to serve the summons/notice on you. If you involve in litigation it may takes years together.

For full procedure contact me on mobile through Vidhikarya.

A.Dear Mr. Sudhakar VVn,
It will be appreciated if everything can be settled mutually.
If you are not happy, get a divorce with mutual consent which can be settled within 6 months.
Coming to the other question whether the bay is yours or not can be verified through Paternity test/ DNA test. Nothing to worry.
Going to/ Migrating to canada without information will invite more problem for you.

A.better go for mutual consent divorce (MCD) which takes 6 months to dissolve the marriage and settle the differences before migrating to Canada. Don't pay her more than 20% of settled alimony amount before getting a decree of divorce.

don't pay her any money if she doesn't want to give you divorce. Generally in MCD cases, a lump sum amount is settled between the couples before a decree of divorce is pronounced by the court. Where as in contested divorce the court determine what would be the amount for maintenance of wife and child which depends on a number of factors which taken into consideration by the court. Now coming to your situation, if you go to Canada without settling your differences, and later while you're in Canada you come to know that she had filed false cases against you and your parents then it will be more trouble for you and your family. For a better guidance you should contact me through Vidhikarya for arranging a telephonic consultation.
