Provision to keep the child in my custody I am Childs mother after filing Divorce Petition
7 months ago
I am wanting to apply for Divorce and I want to stay separetely with my 06 year old child with my parents . Is there any provision in the court of Law for me to keep the child in y possession without my husbands interference
A.Dear client,
In case of a minor child, both the parents have an equal right over the child after divorce. If there is no mutual consent, the family courts decide who gets to keep the child and take his/her major life decisions.

A.Dear Client
As per the law mother is the natural guardian and it is always easy for the mother to get the custody. In case the father files for custody rights then you will have to fight in the court.
