A.Dear Client,
The usage of common areas and open spaces in a society or housing complex is typically governed by the society's bylaws and rules and regulations. These bylaws and rules can vary from one society to another. Therefore, whether it is legal to use the alternate gallery or open space for storage in your society depends on the specific rules and regulations set by your society's managing committee.

Here are some general steps to determine the legality of such usage:

Review Society Bylaws: Obtain a copy of your society's bylaws and carefully review them. These bylaws should outline the rules and regulations regarding the usage of common areas, open spaces, and galleries.

Check with the Managing Committee: Contact the managing committee of your society and inquire about the rules regarding the use of common areas. They can provide you with guidance and clarify whether such usage is allowed.

Approval: If your society's bylaws permit storage or usage of common areas in a particular manner, you may still need to seek approval from the managing committee or the general body of the society. Approval processes can vary.

Compliance: Ensure that your usage of the space complies with any conditions or regulations set by the society. For example, there may be restrictions on the type of items you can store, safety measures, and cleanliness requirements.

Respect Neighbors: Be mindful of your neighbors and ensure that your usage of the common area does not cause inconvenience or disturbance to them.

Documentation: It's advisable to document any approvals or permissions you receive from the society's managing committee in writing to avoid potential disputes in the future.

If your society's bylaws prohibit such usage or if you do not obtain the necessary approvals, using common areas for storage could be considered a breach of the society's rules, and you may face penalties or be asked to remove the storage.

To ensure that you are in compliance with your society's specific rules and regulations, it's essential to communicate with the managing committee and follow their guidance and instructions. If there are disputes or concerns, you may also consider seeking legal advice or mediation to resolve the issue.
Thank you.
