A.Dear Client,
Having sanction for the construction of building up to the fourth floor and having no OC or CC for the rest of the Floor, you may face a lot of legal consequences while selling out the property because the rest floors of the building were constructed without the approval of the revised Building Plan of the competent authority.

t's essential to clarify the status of the conveyance deed and the occupancy and completion certificates for your flat. These documents are crucial when selling a property in India. Here's some guidance on what to do:

Conveyance Deed: The conveyance deed is a legal document used to transfer the title of the property from the builder/developer to the housing society or the individual flat owners. It establishes the ownership of the property. If your housing society or association has already executed the conveyance deed, it's a positive sign. You should check with your housing society's secretary or management committee to confirm the status of the conveyance deed. If it's been done, you can proceed with the sale.

Occupancy Certificate (OC) and Completion Certificate (CC): OC and CC are essential for legal occupation of a building. If your building only has an OC and CC up to the 4th floor and your flat is on the 7th floor, this is a concern. You should check with your local municipal authority or the builder/developer regarding the pending OC and CC for the upper floors. Without OC and CC for your floor, it may be considered illegal, and this could impact your ability to sell the property.

To address these concerns and ensure that you can legally sell your flat, consider the following steps:

Contact the housing society's secretary or management committee to obtain information about the status of the conveyance deed and any pending certificates (OC and CC).

Engage a legal professional with expertise in property transactions to guide you through the process and address any legal issues or discrepancies.

Check with the local municipal authority or development authority to inquire about the status of OC and CC for the upper floors of the building.

Work with the builder/developer, if necessary, to expedite the process of obtaining the required certificates for your floor.
