Asking RTI information from own Employer Asking RTI information from own Employer

Sir/Mam, I am working in a PSU Bank since last 10 days and applied for RTI to my own Employer yesterday. I want to know can a PSU Bank employee ask for RTI information from his own Employer (BANK). Can bank take any action/disciplinary/show cause notice for asking any information through RTI.

A.Dear Client,
As an employee of a Public Sector Undertaking (PSU) Bank, you have the right to seek information under the Right to Information Act, 2005. The RTI Act allows individuals to request information from public authorities, including PSU Banks, regarding various matters. The information sought must pertain to the functioning of the bank and not be of a personal or confidential nature

A.Dear Client,
Being a citizen, an employee has an equal right to information. As the RTI is part fundamental right guaranteed under Article 19(1)(a) of the Constitution, the RTI cannot be denied to the employee. The Act gives the right to information only to the citizens of India. A public sector Bank comes under the purview of the RTI Act. As per Section 6(1) of the RTI Act, 2005 an individual, who wants to obtain any information as defined u/s.2(f) of the Act, shall submit an RTI Application to the designated Central Public Information Officer(CPIO) or State Public Information Officer(SPIO) in writing or through electronic means in English or Hindi in the official language of the area, with fees as prescribed under Rule 3 by the state or central government. The request for information has to be made in writing, clearly specifying the information sought under the RTI Act with proper contact details like postal address, telephone number, fax number, email address for contacting back either for clarifications/advice or for providing information. A Government employee could seek information under RTI Act from the concerned Public Information Officer. There is no provision in Central Civil Services(Conduct) Rules or All India Service(Conduct) Rules, that stipulates that an employee should inform/intimate his employer, if he/she wishes to seek information from any authority, under RTI Act. There is no bar or no need to seek approval under any rules to get information under RTI Act. The applicant cannot seek information from a Public authority which is exempted from disclosure under Sec.8 of the RTI Act, 2005. The matter you referred in the context may be different or irrelevant in your case because the decisions or orders vary from case to case based on the facts and merits of the case. In this context, an Order/Decision of the Central Information Commission passed in Manju vs Department Of Posts on 14 June, 2017 (Ref. CIC/POSTS/A/2017/130777) may be referred.

A.Dear Sir,
Yes, own employee can file RTI application to his employer and get relevant details. It does not invite any disciplinary action.
