Regarding unathurized designation change in Government Office Regarding unathurized designation change in Government Office

Sir,

I am working in central govt. autonomous Institute from last five years on regular basis and my employer with his whims and fancies changing my designation to a lower level without reducing my pay and perks (Say old designation is Statistical and Planning Officer and new will Statistical Assistant). What can I do in the matter, since this designation change will hamper my future career and social life as well. However, Act and regulations of the organisation doesn't allow the employer as well as the board of governors to take any such decision. To adjust their candidate against my regular post they are making this change of designation, so that I could feel me mentally harassed and leave my job.

A.Dear Client,
Frequent changing of the designation of an employee in the absence of any valid reason is not a fair practice and is unethical too especially when it may affect the future career of an employee. Any change affecting the service condition of an employee requires due notice of change before implementing the proposed change. When the Act and regulations of the organisation doesn't allow the employer for freequent change of designation, the action may be termed as unfair and unjustified if the matter is litigated before the appropriate forum or court. However, before moving ahead with litigation on the subject, you need to represent your grievance before the Head of the Deptt. for a resolution failing which, you can escalate your grievance before the CAT(Central Administrative Tribunal) which has been established for adjudication of any disputes related to service and conditions of service of persons appointed for public services by the Central Govt.. So, try to get the matter reviewed by an expert professional(Advocate) handling the relevant cases before CAT challenging the arbitrary and unethical action of the Head of the Deptt. affecting service conditions.

Take a close look at your employment contract, any relevant policies, and the regulations of the autonomous institute. Understand your rights and the provisions regarding job designations, promotions, demotions, and related matters. Discuss your concerns with the human resources department or relevant authorities within the institute. Seek clarification about the reasons behind the change in designation and express how it is affecting your job satisfaction and future prospects. Provide a clear and well-documented case supporting your claim against the change.
