I had purchased a flat from Saraswathi mother of the builder Satish. I came to know that the builder had already sold the same flat on uds to his mason and got loan. HE has changed the village name in EC so it did not reflect when I checked ec before buying the flat. I have filed a complaint in the police station. The builder and mason are ready to transfer to my wife's name. I want to know ehat is legally correct, to declare the other document as null and void through court in the name of mason or do do a ratification deed. please advise

A.Dear Client,
Filing a police complaint is a step in the right direction to address fraudulent activities. However, the police complaint alone may not resolve the property title issue. Consider taking legal action to address the discrepancy in the property documents. File a civil suit to declare the other documents as null and void or seeking specific remedies based on the facts of your case. If the builder and mason are willing to transfer the property to your wife's name, a ratification deed may be one way to regularize the transaction. Any transfer of property interest, whether through a nullification process or a ratification deed, would likely involve the registration of documents. Ensure that all legal formalities related to registration are followed.
