A.Dear Client,
To cancel the Gift Deed, the donor is required to write a petition to the court. In the petition, the clauses for canceling the deed should be mentioned. A notice will be dedicated through court for the donor and the parties involved. Only the donor and donee are needed to be present during the cancellation procedure of the Gift Deed. Before issuing a ruling, the court will hear the arguments from both sides and weigh the available evidence. The petitioner may get a certified copy of the court’s ruling canceling the Gift Deed and deliver it to the registration office where the Gift Deed was registered. The Gift Deed will thereafter be removed from the registration office’s files. Reach out to an Advocate for guidance and steps.

A.Dear Client,
Canceling a gift deed and selling the property can involve legal complexities, especially when the recipient is a minor. In many jurisdictions, a gift to a minor may have certain legal restrictions. Your grandmother may not be able to unilaterally cancel the gift deed without proper legal grounds. If she intends to sell the property for her daily needs, she should consider consulting with a legal professional to explore the available options. This might involve seeking court permission or establishing that it is in the best interest of the minor to revoke the gift. The legal issues in purchasing such properties are significant, as potential buyers may be hesitant due to the existing gift deed. It is advisable to involve legal experts to navigate this situation, ensuring compliance with applicable laws and protecting the rights of all parties involved. Obtaining a court order may provide the necessary legal framework for revoking the gift deed and selling the property, taking into account the welfare of the minor recipient.
