Under construction Property not delivered yet Under construction Property not delivered yet

I purchased a 3 BHK in year 2013 from DPL. The handover date was scheduled in 2017 but not delivered till date. Builder went to NCLT but shorted out that. I stopped payments in year 2014 and communicated to site coordinator, i will not pay until handover. Builder sent me cancelation notice. He refused to pay amount to us. Till date project progress is very slow. What are my options for recovery of my amount.

A.Dear Client,
Given the situation, you may consider the following options for the recovery of your amount:
1.Legal Action:Consult with a real estate lawyer to explore legal avenues. You can file a case against the builder for the delayed possession and non-compliance with the agreement. The lawyer can guide you on the specific legal steps based on the contract and prevailing real estate laws.
2.Consumer Complaint: File a complaint with the appropriate consumer forum. If the delay in possession violates consumer rights, the consumer court can intervene. Provide all relevant documents and details of your case.
3.RERA Complaint: If your country or state has a Real Estate Regulatory Authority (RERA), you can file a complaint with them. RERA is designed to protect the rights of homebuyers and regulate the real estate sector.
4.Negotiation: Attempt to negotiate with the builder for a resolution. Engage in discussions, possibly through mediation or arbitration, to find a mutually acceptable solution. This could involve getting your money refunded or obtaining possession as per the agreed terms.
5.Consult Other Buyers:If other buyers in the same project are facing similar issues, consider forming a collective and seeking legal advice as a group. A joint approach may strengthen your case.
Always seek advice from a legal professional who can provide guidance tailored to your specific circumstances and the applicable laws in your jurisdiction. They can evaluate your case, suggest the best course of action, and assist you in pursuing your rights effectively.
Thankyou
