I have a loan fron HDFC bank which i availed on 14 june 2023. My emi of rs 46771 is on time every month but every month i am getting rs 6749 amount as refund in my account. Bank is saying that someone else is making payment on my loan no by mistake. Shall i am liable to bank to pay the excess amount that i had received by mistake from bank as they are harrasing me to pay the excess amount that i get but i am unable to pay.

A.Dear Client,
If you mistakenly receive something that doesn't legally belong to you, it's your responsibility to promptly inform your bank in writing to rectify the situation and hold them accountable for any failure in addressing the irregularity. Attempt to negotiate with the bank first, and if unsuccessful, escalate the matter by bringing it to the attention of higher authorities within the bank. Additionally, filing a complaint online with the regulatory authority RBI is advised. If all else fails, consider serving a legal notice to the bank and pursuing a complaint before the District Consumer Commission for deficiency in service, seeking compensation for any resulting harassment and litigation costs.

A.Dear Sir,
The principle is NO BODY CAN ENRICH HIMSELF AT THE COST OF ANOTHER PERSON. Thus you are suppose to refund that amount.

A.Dear Client,
If a thing is not yours, legally you are not entitled to enjoy it. Even by mistake,, if it is credited to your account for couple of months, you should inform your bank in writing for regularisation to make them liable for deficiency on their part in not regularising the anomaly or irregularity caused by default. So, try to negotiate the matter with the Bank in any suitable terms failing which you need to bring the matter to the notice of the higher authority of the Bank and make a complaint online to the regulatory authority RBI failing which serving a legal notice to the Bank, file a complaint before the Dist Consumer Commission against the Bank for deficiency in service claiming compensation for harassment and cost of litigation.
