I was working with a organization from April 2014 in Sep 2018 I gave interview with a new organization selected but due to some issue not able to joined the new one but in between new employer created my PF number dated 1 sep 2018 and I didnot left the old employer. On Apr 2019 I left the organization and after 3 months I started withdrawing pf from my account but my claim rejected due to DOE not closed by my previous employer which I didn't join. After raising grievances employer closed my DOE dated 2 sep 2018. with an amount of nearly 43+30+12. when I again applied the request my request was approved an amount of Rs. 73 was credited to my account. but not my previous pf amount which was nearly 1.30 lakh. then I raised Form 13 for the transfer amount and the amount transfered to current employer now when I am request for withdrawal my request rejected due to service overlap Kindly suggest.

From the contents of the query, it appears that the appropriate steps for rectification of overlapping of service were not taken either from the side of the current employer or from the employer to whom you did not resume. In the given situation, to resolve the issue of overlapping in the P F records of both employers, you need to approach the office of Regional P F Commissioner who is the competent authority to resolve any anomaly arising out of date of appointment and date of discharge in EPF records. A joint declaration form is used to correct Provident Fund (PF) member details. It is a combined form that the employee and employer jointly sign and submit to the regional PF commissioner to update the wrong information entered in the employees’ PF accounts. An individual can file a complaint using the EPF i-Grievance Management System (www. https://epfigms.gov.in/). If the grievance is not resolved, you can approach the Employees’ Provident Funds Appellate Tribunal (EPFAT) which was constituted under the provisions of the Section 7 D of the EPF and M P Act 1952, Now, as per the Finance Act 2017, the Employees' Provident Fund Appellate Tribunal has been merged with Central Government Industrial Tribunal w.e.f. 26.05.2017. So, if no relief yields from the office of the PF Commissioner, you may approach the Central Government Industrial Tribunal concerned seeking appropriate relief in the matter.
