Hi team, I was in a relationship and my partner and his bank manager friend made me take a loan on my car in 2017. I was told that the amount is 2 lakhs but few years ago I got to know that the actual amount is 3 lakhs. Secondly only 1,70,000 was transferred to my account rest the bank manager transferred to some other persons account without my knowledge as per discussion with my partner. I also paid 60 k whenever possible, then during COVID I was not working and loan increased to 10 lakhs. When I received a call from branch I told them to give me a proper amount to repay after deducting my paid amount and only based on 1,70,000 which was given to me by the bank. Now I got a notice of 15 days saying I had given a cheque of 3,78,000 and that has bounced, but I had no discussion of cheque neither given any to them. Secondly the bank in which they deposited the cheque I had closed the account 2 years ago. Now when I contacted their head office with my concern they want me to resolve with the same branch and bank manager. Please suggest on how I can resolve the problem.

A.Dear Client,

If you have a grievance with your bank, start by contacting the Grievance Redressal Officer (GRO). If you don't receive a satisfactory response, escalate the issue to the Reserve Bank of India (RBI) by submitting a detailed complaint on their grievance redressal portal. If the matter remains unresolved, consider sending a legal notice to the bank or filing a complaint under Section 35 of the Consumer Protection Act, 2019, with the District Consumer Commission. This should be done within two years of receiving notice of dishonor of a cheque from the bank.

A.Dear Sir,
You may approach Banking Ombudsman if not resolved you may lodge complaint with Police for manipulation of accounts etc.

A.Dear Client,
In the given scenario, you can escalate your grievance with the Grievance Redressal Officer of the concerned Bank, and in case no suitable response is received from the GRO of the Bank you should bring the matter to the notice of the regulatory authority RBI by posting a complaint in detail against the lender Bank online on its grievance redressal portal under the integrated Banking Ombudsman Scheme at https://cms. rbi.org.in for a quick resolution to the matter failing which serving a legal notice to the Bank, file a complaint under Sec.35 of the Consumer Protection Act, 2019 against them before the District Consumer Commission for deficiency in service and unfair trade practices claiming compensation for substandard service and harassment along with cost of litigation. Complaint should be filed within two years of the date of cause of action i.e, on receipt of notice of dishonor of cheque from the Bank. Reach out to an Advocate dealing with consumer court cases for guidance and steps
