Under Section 4 of the Juvenile Justice (Care and Protection of Children) Act, 2015, each district must have one or more Juvenile Justice Boards, comprising a Metropolitan Magistrate or a Judicial Magistrate of First Class. In your situation, you can approach the Juvenile Justice Board of the relevant district to address the challenges posed by your son's behavioral issues. After counseling and assessment, the Board may recommend temporary placement in an Observation Home while an inquiry is conducted. These facilities offer various services to children, including education, healthcare, vocational training, and counseling. Non-institutional options such as sponsorship and foster care are also available. Additionally, you can file an online complaint with the National Human Rights Commission and the State Human Rights Commission to seek further assistance.
Under Section 4 of the Juvenile Justice (Care and Protection of Children) Act, 2015, the State Government has to constitute for every district, one or more Juvenile Justice Boards consisting of a Metropolitan Magistrate or a Judicial Magistrate of First Class not being Chief Metropolitan Magistrate or Chief Judicial Magistrate for exercising the powers conferred by the Code of Criminal Procedure, 1973 and discharging its functions relating to children in conflict with law under this Act. In the given scenario, you may approach the Juvenile Justice Board of the concerned district explaining the ordeal and threat/apprehension you are facing from your son's behavioral disorders for a resolution in the matter. After counseling and assessing the behavioral pattern of the child in conflict with the law, the Board may recommend sending him to an Observation Home temporarily during the pendency of inquiry. Under institutional care, children are provided with various services including education, health, nutrition, de-addiction, treatment of diseases, vocational training, skill development, life skill education, counseling, etc to help them assume a constructive role in society. The variety of non-institutional options include sponsorship and foster care including group foster care for placing children in a family environment that is other than the child’s biological family, which is to be selected, qualified, approved, and supervised for providing care to children. Apart from this, you can inform your plights by sending an application online to the Chairperson, the National Human Rights Commission, New Delhi at (https://nhrc.nic.in/complaints/complaints/how-to-file-a-complaints) and the State Human Rights Commission praying for necessary action. Further, you can get in touch with a social worker or NGO who renders dedicated service to help you out of the crisis.
You may immediately lodge complaint with higher police officers and also file domestic violence case.
