A yputuber threatened me that he will filled a case against me for extortion
1 week ago
hello I am From India
I used to work as a YouTuber's manager. And I had access to that YouTuber's channel. One day that YouTuber misbehaved with me and fired me. So I removed his number and gmail from his channel access to take revenge and added my gmail and number.
Then he begged a lot to return his channel, but I told him that now this channel is legally mine, so I will not return the channel to him for free, I can sell him the channel for 9000 rupees. After that I continued to argue with him. After 8-9 hours I got a call from cybercrime and police threatened me and said they will arrest me. I did not return the channel to him.
Then the YouTuber started blackmailing me that if I don't give him back his channel he will file a case against me and arrest me, I got a little scared, then he told me that if I give him back his channel He will take back what he did and withdraw all complains .
Then I gave him back his channel, but after returning the channel he is blackmailing me that he has filed a case against me and now he will arrest me by police for extortion case and ramson case. But I didn't take over his channel by myself, he gave me access to his channel himself a few months ago, and I wanted to sell his channel to him, I didn't ask him for money for any other reason.
And I got scared and returned his channel and didn't take any money, but he is threatened and blackmailing me of arresting me. Have I legally committed any crime for which I can be arrested? And what should I do now if I am likely to be arrested or have committed a crime unknowingly by me?
please help i am totally frustrated.
From the contents of the query, it appears that with an intention to take revenge against the Youtuber, you take the law into your own hands by changing his number and Gmail account which makes you liable to face legal consequences. To protest an illegal action of an employer, you need to opt for other legal remedies to challenge such action, but instead, you removed their number and Gmail account in your favour unauthorisedly. Accordingly, for such unauthorized access to other accounts, YouTube might have filed a complaint against you for extortion u/s.383 of IPC and criminal intimidation (Sec.503 IPC) with the Cyber Cell and the concerned Police Station which they did not withdraw on receipt back of their YouTube channel from you on fake assurance to teach you a lesson. So, on receipt of a notice or summon under Sec.41 Cr. PC from the police station asking you to appear before them to record your statement and evidence, you should hire the service of an experienced criminal lawyer to defend your case in the right way to get yourself acquitted of the criminal charge of extortion and criminal intimidation.
In this case, with respect to the facts mentioned, if the dispute between you and the youtuber is resolved without any monetary exchanges and if you do not possess any other holdings of the youtuber, then you would be free from the legal charges. But, despite settling the issue, if the youtuber is still blackmailing and threatening you, then you can file a complaint against him. Blackmail and Threatens intending to injure the person and their reputation is a serious offence under Section 503 of IPC. It amounts to criminal intimidation and the perpetrator shall be punishable with imprisonment and fine. So, in this case, you can file a police complaint against the youtuber for the offence of blackmailing and the officers will be able to take appropriate action.
Hope it helps.
Thank you.
