I own a builder floor of 4 storeyed building in Delhi. Top floor owner has roof rights as part of his sale deed.
Due to some issues, he has locked the entrance of terrace and not allowing us to clean the water tanks. Since he is an advocate, police is also not taking any action against him.

On repeat complaints to Delhi Police, they replied that Top floor owner does not have any objection in allowing cleaning of water tanks. However in actual Top floor owner does not allow to go on terrace for water tank cleaning.

What are the remedies available to us?
1. How can we prove that he is not allowing us to clean water tanks kept on terrace?
2. Under which sections we can file cases against him for violation of fundamental right to live?

A.Dear Sir,
You may approach Deputy Secretary of concerned department or lodge a complaint with police or directly lodge complaint before Magistrate.

A.Hi,
It is advisable to you to record the incident as it can be used as a solid evidence and you can file for an injunction suit.

A.If societies register then whole members having such laiblity otherwise you can file complaint against the society chairman or management bodies
