Hi all,

My wife has put a false DVC case and she stopped coming to court. She came to the court twice in the past 3 years and last time she did appear on 29th July 2019. Her cross examination was eschewed. I could see that the judge himself is not dismissing the case even though we asked him to dismiss the case several times. The Judge seems to have no knowledge(writes bad English) and he is totally inclined towards her. Recently that judge got transferred(In corona time). I have to appear to my case now. I wanted to file/register/complaint a case against the judge for not taking any action/inclined toward a party. Please let me know what is the case that can be filed against a judge if he misbehaves. Definitely a judge doesn't mean he can do anything on his wish and he himself is not a god. So there should be some punishment for judge also if he inclines towards a party. Please advise me on that.

A.Hi,
You can make an application directly to the High Court to quash false cases under Section 482 CrPC. We would not recommend that you take any action against the Judge, especially when your case is still in the process of being adjudicated.

A.Hi,
False cases can be quashed by the High Court when an application is made under Section 482 CrPC. It is unwise for you to antagonize the Judge, as you can be found guilty of contempt of Court.

A.File an application before District judge to transfer your case to some other court. Mention reason with proper justification.
