I check this online

Notice could not be issued to accused as copy of complaint etc. not filed.
Copy filed today. Now, fresh notice to accused be issued for 09.09.2018

whats meaning of this

GANESH SHARMA

Responded 5 years ago

A.It means you have not supplied the copy of the complaint for the accused for summoning him. You have to give a copy of the complaint to the accused so that the service of the notice/summons could easily be executed to proceed in to the trail further

A.As far as i am getting it is a complaint case in which summons have been issued by the honble court.
It means that on kast date of hearing you have not filed the copy of complaint so notice was not issued to the opposite party. Hence the case has been adjourned for the same purpose for next date of hearing

So you are the accused?
The diary entry actually means that notice could not be issued to you because an extra copy of the complaint was not there in the Court. Now Mr. Naresh has filed another copy of the complaint. So the court will again send notice to you along with a copy of the complaint. And after receiving the complaint, you have to appear before the court on 25.09.2018

that really depends on a lot of things. Like how long has the case been pending for issuance on notice, etc.
It is advisable to appear in any case, whether or not you receive it.

No that is not a good idea. If you have to compromise the case, please file a proper compromise Memo where the Court knows that you have made the payment and that Mr. Naresh is willing to close the case. The stage where you can simply send money and the proceeding gets over has already crossed.
