Sir, A partition deed was made between brothers regarding the division of property between themselves and it was clearly stated in agreement that to pay taxes in their own name.But from then we are paying the house tax since 14 years for their property also.can we claim that property as ours on the ground that we are paying the taxes since longtime?

A.There's no provision in law that you become can claim a title to the property on the bases of paying corporation/municipal taxes. Once a partition deed is registered, each claimer has their own right in their share portion. You can apply to the corporation/municipal authorities to issue separate tax bill of your portion in the property. This is done by submitting the partition deed along with mutation form and application. If you had paid house tax since 14 years, you may file a civil suit for recovery of the money you paid paid for house tax. Please contact a local lawyer from Vidhikarya.

Yes sir, it is ancestral property. Should we claim this as ours in the court of law , or by any way can we first register the house in ours name , since the entire house is in ours name in the online records.

A.What is the status of the property. Whether it is ancestral or anything else? Paying taxes doesn't make you the owner of the property

It is ancestral property and in online records we are having our name for the entire house since we are paying the taxes.can we register our house first in ours name?

A.Partition deed has no value unless t is registered or got effected through court.paying of taxes also does not pass on tittle to the suit property.
