My parents purchased a property in Vasai in 1998. We are now looking to sell off the same owing to financial difficulties. But the property which was in resale ( we are 4th buyers) is an old one. The documents that I have are only our sales agreement in original. Rest chain is xerox copies. We have been paying all society dues, property tax , water tax, electricity bill regularly On the agreement the stamp duty paid stamp is there. But we don't have the stamp duty receipt. Registration of the property is also not done. And the past buyer is dead and his heir is not in contact. How can I sell or make strong paperwork? Can we declare my mom as the sole owner through court?

A.You may approach the Vasai Court for filing a declaration in this respect but I would advise you to first confirm from the office of Sub-Registrar if the same is needed as although the previous Agreement is not registered but you have all the society and municipal office records in your name and also see if adverse possession basis it can be worked out with office of Sub-Registrar. Just confirm first before you approach the Court. Thank you.

A.Dear Client
While buying the property you did not make a sale deed and got it registered hence in absence of that your position is not very clear as far as title of the property is concerned. You can also try to sell the property the way it was sold to you.
Second way would be file a suit for declaration and get the ownership after the decree is passed,

A.Dear Client,

As it is jointly owned property, therefore, your mother cannot be the sole owner of the property.
You can contact the other 3 owners or their heirs asking them ti waive their rights over the property.

A.Dear Sir,

You cannot sell that property but can enjoy or rent it out or lease it out. You are not having proper documents. Better get file a suit for declaration and get a decree.
