Ground floor and first floor independent house owned by three co-owners. One of the co-owner locked first floor of house in presence of other two co owners and no questions were asked, the reason co owner decided to lock house was due to their belongings and costly items there and as other two co owner didnot ask for key at that time, co owner had work out of town so he locked house and proceeded in presence of other two co owners and both didnot ask key, now one of co owner is mentally harassing and threatening co owner who is out of town by saying they will break lock of the house and start living, moreover asking co-owner not to return but to parcel key, what can be done in such situations, as the co owner is aged women and mentally harassing and threatening and even they are abusing her, phone records of same are available, what can be done regarding this situation, co owner is abused so much that they are fearing for their health and donot want to return as of now and are ready to take legal advice.. in all these one co owner is neutral and not interfering, another co owner is abusing, harassing and threatening to break lock.
You may approach Police and ask the Police to hand over all the belongings of their respective co-owners. Thereafter, if issue is not settled you may go for selling the house and if not agreed get the permission from the Court and if one of the co-owner not ready to purchase your share then you can pray to the Court to put the entire building for public auction.
you can file a complaint or register FIR with police for mental abuse against that co owner and show the evidences you have.
