Company wrongfully deducting salary

company is deducting salary of employees for past 3 months without any written communication or information. Company didn’t pay leave encashment money then started deducting salary. 1st month they deducted 15% gross salary and 30% in next month. No communication regarding future couse of action is given by company and no surety when will the deducted salary be given back. Its a limited company. Employment agreement states that all disputes to be settled through sole arbitrator appointed by company. Pl guide what can be done.

A.You see a company whether a private or public cannot deduct your salary without giving you a proper reason to which you have agreed. If they are deducting your salary then it is wrong as per the Contract law (if it is a private limited company) and as per Labour Laws (if it is government company or organization). Since in both the case it is a wrong being done by the company so you have all the rights and options to take legal action against them. I would suggest you first speak to them and find out the reason why they are doing so. If you are not satisfied with the answer then send them a legal notice or if needed go ahead and file a case.

Information is insufficient. What is your pay now, what amount your employer deducted without your written authorization. Who is the arbitrator. You must consult employee redressal forum in your company. What are other employees doing in similar situation. Now you are in that company and you should settle the issue amicably by consulting H.R. or other senior level officers. You must ascertain the reason for their deduction. If it is for paying taxes or for any other purpose you must ascertain first of all. If you want come out form the company then you must approach Labour welfare officer in Labour tribunal for recovery of unlawful deductioin.
