Sir,i have got married in Feb 2013,after marriage my wife being always trying to fight and ready to live with her parents,this process was very frequent and in 15 sep 2105 she completely started to live her parents house except on diwali occasions she came for 1 day now after 15 sep 2015 she came back in 12 sep 2018 and still I do not know how much time she will staty ,she is also not allowing me for physical relations and the result is that we do not have any child till now ...she is very cruel,emotionless and my life is completely disturbed ,now pls suggest how to separate.

A.Dear client if your wife left your house and deny for cohabitation then you can send legal notice through lawyer or file divorce case on desertion and cruelty grounds

A.Your wife does not appear to be interested in living with u ask her openly whether she wants divorce by mutual consent..next time she leaves, send her a legal notice and file a petition for divorce on the ground of cruelty and desertion.

A.Facts not clear. What you want divorce or continue your married life with her. For divorce file a divorce petition on the ground of cruelty and desertion. Alternatively speak with her for MCD which takes six months to dissolve the marriage. If you intend to continue your married life with her you can file a restitution of conjugal rights application before the court giving her an opportunity to resume her conjugal duties.

Note: Since she had left the matrimonial house of her own free will and have no sufficient reasons, she is not entitled to maintenance. But for this you need to make out a strong evidences so that she doesn't get maintenance. I hope you have earlier given her notice to come back and resume her conjugal duties etc.

A.Dear Client, you should get rid off by mutual Divorce. But I do not think so she will do, She comes frequently bzc you have nit taken any legal action against your marriage issue. You can file divorce case against your wife on the ground of cruelty under Hindu Marriage Act. One more kind of marriage which is prevalent is Mutual consent divorce under section 13(b) Hindu Marriage Act.

A.Tell me clearly that what u want ? If u file a divorce petition then u will have to pay monthly maintenance and cost of litigation. Tell me that do u want to live with her ?
