Hi ,

I got married 2 years before. Now i have a male child of 4 months. From the day of marriage i was mentally abused by my husband. He starting doubting me in all aspects. And he bet me within 4 days of my ceaserean surgery.

Now when i checked his mails i came to know that he had many illegal girls contact and was with many prostitutes before marriage and 1 girl has become pregnant because of him. Even after marriage he has messaged those girls and tried for prostitutes too.

Knowing all i am not ready to live with him.

WILL I GET COMPENSATION IF I FILE DIVORCE CASE FROM MY END WITH THE ABOVE DETAILS

A.Dear client kindly file a 498(A) case against your husband also You can file a divorce case against your husband. You are eligible to take maintainace and alimony into divorce case

A.Dear Client,
In the present scenario, first and foremost, you should file a 498(a) case against your husband in the nearest Mahila Police Station. You can file a divorce case against your husband on the basis of grounds mentioned in section 13 of Hindu Marriage Act. So far as maintenance is concerned, you are eligible to take maintained under section 24 HMA and later permanent alimony.

I am from tamil nadu sir.
If i file under congucal rights is that fine or it is better to file divorce case itself. Because i am not ready to live with him but compensation is needed for my son

No RCR is nota good option. You have plenty of material. Go for divorce without any doubt. Get the petition drafted by some expert lawyer and file it

A.By advocate Rameshwor dadhe dear mam this are the some grounds for getting divorce from Ur husband. You should file divorce petition. Adultery or cheating.Bigamy.Desertion.
Mental incapacity at time of marriage.
Marriage between close relatives.
Impotence at time of marriage.
Force or fraud in obtaining the marriage.

A.You can file for maintenance. You can also lodge a complaint under domestic violence act (PWDV) and chewing under IPC.

It doesn't matter, maintenance is a statutory relief under CrPC, DV act & Hindu laws.
