i applied divorce case in karnataka. before i apply to divorce my marriage is not completed one year. lawyer now saying withdraw case bcz one year also not complited while filing divorce. what to do now? shall i continue the case or withdraw. i dnt need divorce bcz i dnt marry again

A.Dear Sir,
Just file an application under the following proviso to Section 14 of HMA Act.

[before one year has elapsed] since the date of the marriage on the ground that the case is one of exceptional hardship to the petitioner or of exceptional depravity on the part of the respondent, but if it appears to the court at the hearing of the petition that the petitioner obtained leave to present the petition by any misrepresentation or concealment of the nature of the case, the court may, if it pronounces a decree, do so subject to the condition that the decree shall not have effect until after the (read Section 14 and you will find above or approach me for guidance).

A.Dear client kindly mention the best reasons for divorce even if you apply within one year. If court satisfied then you can get divorce but generally there is no exception or options for granting divorce within one year

A.You have to read the latest Apex Court Judgement on qucik divorce, with valid reasons & ground for divorce you can persue quoting the SC Judgement.Better to take up the issue with a Expert High Court Advocate from the panel of Vidhikarya for quick divorce.

A.Dear client file an application in concerned court and withdraw your case. But also think about your future plan. If u want to stay with your wife then there is no need of any litigation. But in case the marriage is completely unsuccessful then decide what u want to do further.If the relations are strained then your wife will file a suit for maintenance against u., and that u will have to pay. Dear client there is a saying that when Love flies through window Lawyer comes through door. All that glitters is not gold and the grapes are not always sweet.

A.You should specifically mention the reasons for divorce even if you apply within one year. If court satisfied for such an urgent grant of divorce it can grant. Other wise court will dismiss the same and you should file fresh petition for divorce.
