2 cases for divorce

Hi ...
I have filed divorce from my end and after filing i came to know that even my husband has filed divorce from his end
Without knowing to each other we have filed 2 cases... how to handle this??

A.You can alternatively file a divorce by mutual agreement.

It would be better for both of you, since both of you want a Divorce.
hence better to opt of convert the same petition as mutual Divorce by mutual consent which would be help you

A.Dear Madam,
It is not a big issue and if both the petitions are filed in the same Court or same city you may ask for clubbing the same otherwise file a petition for transfer of divorce petition to a place where you feel comfortable. The Court will receive common evidence and give findings after raising relevant points for consideration as per allegations and counter allegations made in your respective petitions.

This is easy since both of you want a Divorce.
Best would be a Divorce by mutual consent which can help you
to reduce the time gap of 6 months cooling off period.
Once we have access to the marriage certificates issued by the
Registrar of the respective Government we will know the type of marriage and under which it is governed and accordingly it will be decided.

A.Dear Client Sec 13B of Hindu Marriage Act deals with Divorce by mutual consent. Under this section if husband and wife are living separately for a period of one year or more then they can file petition of divorce with mutual consent. If the application is not withdrawn within a period of 18 months then Court will grant divorce very easily.
Now if u both are willing to get divorce from each other so if you both are living separately since last one year then both of you withdraw your applications and file fresh application with mutual consent. It will save you from long litigation and cross examination in court..
But if it is not possible then As said by my brother Lawyer GANESH SHARMA First divorce petition will prevail. .
