Token money for rent

I had recently looked for a flat through a broker and he made me pay 10000 as a token money for booking it. After 1 day I had to cancel the booking due to some personal reason. No agreements have been signed yet and the flat is already occupied by someone else who was supposed to empty it after 2 weeks. Now the broker is not refunding my money.
A.In the absence of supporting documents like receipt of money paid to the broker for booking the Flat and having no agreement or possession of the flat, the chance of getting your booking money is remote and almost impossible.
