Housing society has not provided any summary, bills of maintenance charges
10 months ago
I reside in a cooperative housing society in Kandivali West. The society has not given us any bills or details in writing about our pending dues and keeps sending us notices with penalty and interest added to the amount. However after having written more than 150 letters demanding for proper bills and details of pending dues, the society refuses to respond. We have never refused to pay the dues but the society doesn't provide written details of pending dues
A.Dear Client,
A housing Society registered under the Cooperative Society Act is dutybound to provide a member of the society with maintenance bills as per the Byelaws and regulations of the Society. In case the Society refuses to issue a bill for maintenance that may be termed as a deficiency in service and unfair trade practice because the Society provides you service on receipt of service charges. In the absence of issue of a proper Bill, they cannot even claim for interest or penalty for non-payment of dues. If the Society is registered under the Cooperative Society Act, then make a complaint before the Registrar of the Cooperative Society concerned to resolve your grievance failing which you may file a complaint against the Society under Consumer Protection Act, 2019 before the Dist. Consumer Court for deficiency in service and unfair trade practice claiming compensation for harassment.
In case you need any assistance in this regard you may contact our legal team along with relevant papers.
