Remarry same person
I got divorced (mutual) 6 days back and now me and my husband want to continue our marriage. Are we supposed to remarry and register our marriage again and get the new date of marriage certificate ? Or we can just start living together and tear off the divorce paper?? Plz clarify
A.Dear Deepa Gh,
Our Learned friend Shreyash Mohta has explained the details of procedure according to the religion and I have nothing to add. Whatever you do , please do it legally, ultimately it is the law which will come to your rescue.

A.Mam, as per your query
After getting a divorce decree from a competent court if you want to remarry with the same person then the process are as follows :
1. If you want to get married under the special marriage act, then,
You have to apply before the registrar of marriage, with appropriate form and also with affidavits of both the parties with witnesses of both the sides.
The registrar will thereafter fix a date & will issue notice for 15-20 days.
If there will be no objection, then, the marriage will be solemnized on the next date.
If you fall under the Muslim religion then, after getting a divorce decree you have to marry a third person , & thereafter he should divorce you.
Only then you can again get married with the same person whom you had divorced earlier.
Under Hindu Laws there is no such compulsion. You can marry the same person after getting divorced following valid rituals and customs & making sure that such marriage is a valid marriage under the Hindu Marriage Act.
Once you marry the divorce decree shall become null & void.
Living in together is also an option but it is always advisable to remarry with proper custom and rituals and have proof of such marriage so that in future neither of the parties face any problems regarding the validity of such marriage & also upon the question of the mutual divorce.
Hope this helped.
