Non Payment of Professional fees since more than two years
Dear Sir/ Ma'am, I am professional guide. A Gurgaon based reputed travel agency sought my service in Feb 2020. After the guiding assignment was over, I submitted my bills and expense details. Covid came and the travel industry went for a complete shutdown. My fees were not cleared. After repeated emails and phone calls, the company transferred Rs 20K out of 80K in Dec 2020. A promise was made that rest amount will be cleared soon. Required TDS was also deducted for the financial year. I kept on sending mails and calling the team. But there was no response. Slowly the team who were handling the tour moved out to a different company. I had to get in touch with one of the directors and appraise him about my issue through mail. He promised to loot into it and forwarded my issue to the finance team. This happened in Dec 2022. Again after repeated request through mail and calls the company released Rs 20K more in May 2023. There has been no response to my calls or emails since then about the pending Rs 40K. Please suggest how to go about it.
This is a breach of contract. Please consult a good lawyer and get a legal notice sent to the travel agency. If this doesn't work out, please file a complaint for breach of contract.
Section 73-75 of the Indian Contract Act, 1872 details the consequences of a breach of contract. In case of any breach of contract, the affected party can claim the damage from the court, and the court forces the other party to perform as promised.
