First party purchased Physical Non-judicial stamp paper (Not E-Stamp) online and at the left bottom side given name of the parties, Consideration Amount as INR - 0, stamp ref.no... 12345656. Underneath, Stamp vendor details are given along with signature, date of sale of stamp and affixed seal of the vendor at the bottom. 90% of the upper area of stamp paper kept empty and said that first page (i.e. stamp paper) only contains the party information and stamp vendor details. Detailed terms & conditions are given in the subsequent pages i.e. from page no. 2(two) to page no. 10(ten) and all these pages having reference no. of stamp paper at the top of the agreement. Mode of signature of the said agreement is proposed through SignDesk e-Signature option. My question is whether keeping the stamp paper empty is safe under proposed system. Also last page (page no.10) kept as a stand alone signature table contains 1st & 2nd party names and signature lines and provision for witness to sign. Further they did not insert running page Numbers in the entire document, though stamp paper reference no. is indicated.

My question is whether is it okay to proceed with first page almost blank and signature table in the last page shown as a stand alone page for an e-signature enviornment ?

A.Dear Client,
On the introduction of digital system of registration of any document through E-registration, value and authenticity of the documents has been raised manyfold than before when it was done manually. Under the system of e-registration, documents including signatures of parties are being done through biomatrice verification and soft copy of which is kept with Registering Authority. So possibility of any forgery or duplication of the document is almost prevented and stopped raising the evidentiary value of the document. Practice under e-registration of documents varies from state to state.

A.Dear client,

The acceptability of having the first page of a contract or agreement mostly empty and including detailed terms and conditions on subsequent pages can depend on the laws and practices in your jurisdiction. Generally, it is recommended to have all parties sign or acknowledge each page of a contract to ensure that they are aware of and agree to all the terms and conditions.

Regarding the use of an e-signature for the agreement, it's important to comply with the laws and regulations governing electronic signatures in your jurisdiction. Electronic signature laws vary by country and may have specific requirements for their validity. You may need to ensure that the e-signature process you are using adheres to these legal requirements.

Not including page numbers throughout the document may not be a significant issue as long as the reference number of the stamp paper is clearly indicated on each page. However, it's generally good practice to include page numbers to maintain clarity and prevent any confusion or misplacement of pages.

To ensure the validity and enforceability of the agreement, it is advisable to consult with a legal professional who can review the specific details of the agreement, stamp paper, and e-signature process you are using. They can provide guidance based on the applicable laws and regulations in your jurisdiction to ensure that your agreement is legally sound.
