My father 75yr old involved in 2 wheeler Accident. other person was of 45yr old was also on 2 wheeler and died in hospital.

my father just entered on the road, other person might applied sudden break. since other person fell on road had measure head injury and died. my father got touch other person so he didn't had any injuries.

this happened 15days back and now other person side people talking about money and filing case on my father.

other has big political and police power. my senior citizen was driving TVS XL without gear bike and has no driving licence and no insurance.

what is best solution in this case for my father. Giving them 5lac rupees or face trial in court?

please suggest.

A.Dear Sir,
It is better to close the matter and take records having paid the compensation in full an final settlement or get it done in Court through Lok Adalath. Since your father is not having any valid license and insurance and the deceased was aged about only 45 years as such if contested the legal heirs of deceased may get a minimum of more than Rs.15,00,000/- as compensation.

A.Dear client,
Any person harassing senior citizens can be brought under Section 506 for criminal intimidation. - If the person is very abusive or utters or recites obscene words and mentally tortures senior citizens, a case under Section 294 can be bought. Hence, if the person is harassing your father, he can file a criminal complaint against him under these sections
