Manjeera Water Connection - Residential / Multi Storied Building - We have 3 BHK and 2 BHK flats in a multi storied building (apartment residential complex) total 35 flats (20 - 2bhk flats and 15 - 3bhk flats) (both 2 and 3 bhk are opposite doors) in Hyderabad, we have received Occupancy Certificate and owners have started residing from the year 2020. Few amenities are also yet to be finished like the new manjeera water connection and drainage connection. There was no association registered, temporarily few owners formed an association initially after some people started residing. The people (from 2bhk) who worked on the quotations divided the individual cost heads into categories of those that have to be paid per sq.ft or UDS of area owned and arrived at some numbers. 3BHK owners are not willing to pay as per that, they want to go on equal basis sharing.
As per the builder's advice - all expenses should be shared uniformly, since it is a residential building and standalone apartment.
Please advise, what does the RERA / law say on this matter and what are the actions that I can take? As a committee member, I am not averse to paying fair costs as per the calculation, but paying sq ft costs like even new water connection in sump, painting to the building, monthly maintenance, which is commonly used or lift AMC's is neither fair nor acceptable.
Charging maintenance fees based on square footage is seen as a fair way to allocate costs among residents. Larger apartments typically require more maintenance and resources than smaller ones, so it ensures that those who use more common resources and amenities pay proportionally more. The reason behind calculating maintenance prices on a square-foot foundation is to ensure a fair distribution of prices among residents. Larger homes typically have more rooms, furnishings, and appliances, which may additionally result in higher consumption of sources including water, electricity and maintenance offerings. By allocating fees proportionately primarily based on the dimensions of the individual gadgets, it attempts to account for the differences in resource consumption. The calculation of condominium renovation fees on a square foot foundation is a commonplace practice in lots of residential complexes and societies. It is primarily based on the basis that larger homes require extra commonplace sources and amenities, resulting in better upkeep expenses. It is recommended that residents study the governing legal guidelines, rules, and the terms and situations in their housing society to recognize the basis for maintenance price calculations and remedies to be had in their jurisdiction. Consulting with property valuers or specialists who specialize in actual property and housing legal guidelines can provide need-based information in the local context.
The total cost for the month is divided by the overall area of the property, which gives the per sq ft maintenance rate for the month. This is multiplied by the unit area of each home to arrive at individual contributions towards monthly maintenance.
