Legal Consultation Regarding Committee Money Dispute Legal Consultation Regarding Committee Money Dispute

I am writing to seek your legal advice and guidance regarding a complex situation my family is currently facing. In 2020, my father passed away, and I have been residing in Australia since 2019. He was a part of a local committee, and we are unsure about the details of the committee's finances. Recently, local individuals have been harassing my mother, pressuring her to pay money related to the committee. Matters escalated when they filed a false threatening complaint against both my mother and me. Furthermore, they visited our home with neighbors and insisted that we pay or be witnesses in court. We have no legal proof or documentation of the committee's financial matters, only witnesses. I arrived in my home country in May this year, and these individuals have threatened to cause problems for my return to Australia based on a complaint they could file.Yesterday, my mother filed a complaint with the local police station, detailing the situation. However, we are concerned about the possibility of facing legal action without concrete evidence or documentation of the committee's finances.I would greatly appreciate your professional insight into this matter. Can they legally take action against us based solely on witness testimony and without tangible evidence of the committee's finances? What steps should we take to protect our rights and address this situation?Your expertise and guidance in this matter would be invaluable, and we are open to scheduling a consultation at your earliest convenience to discuss this in more detail.Thank you for your time and assistance.

A.Dear Sir,
If they filed false case then you just approach the High Court for quashing of such FIR and ultimately it will be quashed. In the meantime you can lodge complaint with Police or else directly file private complaint before the Magistrate.

A.Dear Client,
From the query it is not clear what kind of local Committee your father was attached, how many members were in the said committee, is there any legal recognition of that committee, what is the constitution of the said committee and why your father made standalone victim by the local people/agitator. All these information are necessary to confront the crisis suitably and to access the remedies available under the relevant law of the land and to bring the matter in detail before the Court or concerned authority. When your mother made a complaint before the Local Police Station, the steps can save you from further harassment for the time being. You need to submit a court petition asking for an order of protection. There are no fees. Your abuser's actions toward you must be detailed in an affidavit that you must sign. To obtain an Order of Protection from the appropriate Court, you do need legal representation. As seeking legal counsel before submitting a petition for an Order of Protection may be of great assistance to you. So, reach out to an Advocate along with all the details as asked above ASAP for guidance and necessary steps.

Your mother has taken the right step by filing a complaint with the local police station. Ensure that you follow up on the complaint and keep the police informed about any further threats or harassment. Request protection if you feel that your safety is at risk and also keep a record of all communications with the individuals pressuring you, including any written or electronic correspondence. This documentation can serve as evidence to support your case and provide a clear timeline of events.
