I have a question on the tenant's legal rules and regularization. I rented a room in Noida sector-29 through an agent with the agreement of an 11-month and 6-month lock-in period. It's been 15 days of living there, my mom was there with me and we both caught my landlord (uncle) touching my undergarments inappropriate manner. Same time I informed her wife that he was doing this. But she was not ready to accept it and asked me to leave her room on an immediate basis. Then I asked my agent what was my fault in this and search for a new room for me, I gave him 20 days brokerage for 7500/- rs. He gave me 2 to 3 suggestions but those were not safe places and I didn't find them suitable to live in. Then the agent asked me to find a flat from my end until they found anything. The landlord kept on asking me to leave and harassed me by saying she would lock the room from the outside. Then I found a place and shifted there, the agent said he would return the money after my shift. then in starting of October, I shifted from there. It's been a month and he is not giving my brokerage back and shouting while calling him. I have tolerated it a lot, he allotted that room to me by saying this is a safe place for a girl and all. Now after all this not he is not ready to compromise with me. I have given brokerage 2 times, shifting charges are different. What to do now? My earning is not that good to live in a metro city and then all this fraud. I did not leave the room as I wished, the landlord forced me to leave. what is my fault? Please help how can I get my money back.

A.Dear Client,
If the agent does not respond or refuses to return your brokerage fee, you may need to consider taking legal action. You can file a complaint with the local police or approach the Consumer Disputes Redressal Commission.

A.Dear Client,
After the implementation of the Real Estate (Regulation and Development Act), 2016 (RERA) across the country, real estate brokers must obtain the RERA registration number/ license from the state-level Real Estate Regulatory Authority to operate in the real estate sector. The license is valid for five years from the date of issue. According to RERA norms, only a registered broker can take up the rental brokerage work. So, you can make a complaint for unfair trade practice against the concerned broker before the RERA even if the broker is not registered under the said Act. You can also lodge your grievance to the Public Grievance Cell of the concerned District Magistrate office for redressal of your grievance against the concerned broker.
