A.Dear Client,
The Code of Civil Procedure(CPC) is a procedural law that deals with the administration of civil proceedings in India. The Information Technology (IT) Act, 2000, is the primary legislation dealing with cybersecurity, data protection, and cybercrime and multiple other sector-specific regulations to promote cybersecurity standards. It also provides a legal framework for critical information infrastructure. IPC, Cr.PC and I T Act, 2000 covers issues pertaining to the jurisdiction of computer crimes and also the law applicable in cyber security cases. Section 179 of Cr.PC gives jurisdiction to the courts in India to deal with any computer crime that leaves its impact or effect within the territorial boundaries of India. In a Cyber Security case, system-specific security documentation is required, such as a system security plan, cyber security incident response plan, continuous monitoring plan, security assessment report, and plan of action and milestones, to support the accurate and consistent application of policies, processes and procedures for systems.
