Dear sir
My driver lost his balance and got driven car into the water due to rain, there may be less possibility of external impacts/damages.
And the insurance company deny my claim due to any external impact.

A.Dear Client,
As mentioned by you in your query "There may be less possibility of external impacts/damages," it is to inform you that in the absence of any external impacts or damages arising out of a road accident reported to the police, your claim might have been repudiated by the Insurance Company for lack of substantial and sufficient evidence supporting your claim. Once a claim is raised by a policyholder claiming compensation against damages to the insured vehicle, the insurance company appoints a surveyor to assess the loss in the accident. The surveyors will then carry out a physical inspection of the damaged vehicle and assess the extent of loss. On the basis of the report submitted by the surveyor, the insurance company settled the claim. If the Surveyor's report shows no loss for external impact or damages arising out of an accident, the Insurer repudiates/rejects the claim of the insured. However, when you repaired the car post that incident out of your own pocket and you are in possession of an invoice/Bill for the repair of damages carried on by a workshop/garage and a report of a certified loss assessor certifying the loss/damages, then you may escalate your grievance before the Insurance Ombudsman failing which you need to file a complaint against the Insurance Company under the Consumer Protection Act, 2019 before the Dist. Consumer Commission claiming compensation for damages and harassment. The complaint before the Consumer Commission is required to be filed within two years from the date of cause of action i.e, from the date of repudiation of claim.

The insurance company is supposed to pay the compensation or the repair cost when there is a n accident and accident will be with some external impact, right? You move the consumer forum against the insurance company
