In a specific location in the village, there were initially three families that practiced prayers(not in temple but near tree small stone like idol) Later, my grandfather took the initiative to construct a temple in a different area. Over time, the number of worshippers and visitors to the temple has increased, prompting us to establish a Temple Trust The daily rituals involve the three original families (ours+2) taking turns, while the important festivals are conducted by my family.
now we are doing Temple trust includes families and outsiders that is vilage people , before the registration of the trust, how to maintain important decision making part related to temple rituals and other things in our hand only, future also in same manner even if they build new temple in our hand To preserve my grandfather's legacy and respect for his efforts?
For formation of a trust few basic yet important obligations are needed to be maintained. While forming the bylaws, make everything clear about the intentions you have.
While giving powers or any decision making authority to the outsiders, make sure the bylaws are enough strong and the other members confers the power to take emergency decisions whenever required. This will reduce the risk of any misuse of power, yet will maintain the legacy and respect towards your grandfather and his contributions.
The first and foremost requirement of the formation of a Trust is to make out a Deed of Trust outlining the purposes, and objectives, modus operandi of all the activities, names of founder trustees, board of trustees and beneficiaries, initial corpus fund, donation of land, if any, by the author/founder of the Trust for which it is formed is finalized, it requires registration paying the stamp duty under the Registration Act, to make it enforceable and admissible for all-purpose. So, drafting a Deed of Trust is very crucial and equally important so that it governs all the activities of the Trust transparently and fairly either for a charitable trust or a private trust, and requires to be drafted by an expert professional. So reach out to an expert professional for drafting a Deed of Trust for the management of a Temple and for its onward registration.
To maintain control over the important decision-making aspects related to the temple rituals and other matters within your family's hands, it's advisable to establish clear guidelines and agreements among the involved parties before formalizing the Temple Trust. Engage in open communication with the other families and the villagers, emphasizing the historical significance of your grandfather's initiative and the unique rituals your family has been managing. Consider drafting a memorandum of understanding (MOU) or a written agreement outlining the division of responsibilities, the rotational system for daily rituals, and your family's continued role in overseeing significant festivals. Ensure that the agreement is mutually understood and accepted by all parties involved. While formalizing the Trust, include provisions that maintain the traditions and rituals established by your family, and clarify the decision-making structure to ensure your grandfather's legacy is preserved. Seeking legal advice during this process can further strengthen your position and provide a legally binding foundation for the agreement.
