My father, who lived in Dhuliyan, Murshidabad died in 2021. We live in Kolkata. My mother died in 2018. My father's brother is refusing to handover his identity proofs, bank passbooks, property papers, etc. He's currently occupying my father's property.

In the given situation, serving a legal notice to your uncle, make a complaint against him at the local Police Station and file a criminal suit against him under Sec.420 of IPC for cheating and under Sec.503 of IPC for criminal intimidation in the Court of CJM/ACJM having jurisdiction to try the complaint.
