Can the leave encashment for Earned Leave be calculated on basic+DA only excluding all other allowances (i.e HRA, Petrol, Mobile etc) as per Factory Act 1948.

A.Dear Client,
As per Sec. 78 & Sec. 79 of the Factories Act 1948, workers (who will come under the definition of worker as provided under Sec. 2(l) of the Factories Act) are eligible for 1 day of Leave with wages for every 20 days worked as earned leave (EL) in a calendar year. The earned leave encashment formula is [(Basic Salary + Dearness Allowance) / 30] * Number of EL or earned leaves excluding all other allowances. The workmen will be entitled to get encashment of earned leave @ of 50% of leave due to his account subject to the maximum of 15 days in a calendar year subject to the minimum of 7 days/per year.
