3 months ago
What is the procedure of filling Counter case in ipc 120 A , ipc 209 , ipc 166 ? And how
long proceeding will take time ? A Revenue sub inspector , complainent and other made false claim on affidavit in court to fraudulently initiate 133 crpc against me
A.Section 209 of the Indian Penal Code makes dishonestly making a false claim in a Court as an offence punishable with imprisonment upto two years and fine.
The essential ingredients of an offence under Section 209 are:
The accused made a claim;
The claim was made in a Court of Justice;
The claim was false, either wholly or in part;
That the accused knew that the claim was false; and
The claim was made fraudulently, dishonestly, or with intent to injure or to annoy any person.
if you believe false claims have been made against you and you want to file a counter-case, it's crucial to consult with a qualified attorney to guide you through the specific legal process. Generally, for filing a counter-case, your lawyer would draft a counter-affidavit presenting your version of events and the reasons why the claims against you are false. This would be filed in the same court where the original case was initiated. The duration of legal proceedings can vary widely based on factors like the complexity of the case, court backlog, and the diligence of involved parties. Your attorney can provide a more accurate estimate based on the specifics of your situation. Act promptly, as legal processes can take time, and it's essential to present a strong and timely defense against false allegations.
Thankyou
