The regularization of the property's status, registered in 1943 during the pre-independence era, necessitates compliance with post-independence laws applicable to the said property. The property, not currently reflected in the land records, involves intricate legal and factual considerations, making the transfer of title and registration to the surviving legal heirs currently impractical. Seeking advice from an experienced local property lawyer is recommended. Providing the lawyer with all available property documents for examination will enable them to offer a real-time opinion on the matter. Subsequently, appropriate steps can be taken to navigate the complexities of the situation effectively.
Until and unless the status of the property, registration of which was done during pre-independence days in 1943 is regularised in compliance with the post-independence laws applicable to the said property which is not even shown in the land record and involves a lot of questions of law and facts, transfer of title and registration of property in favor of the surviving legal heirs is not feasible at the moment. So, it is advisable to consult with an experienced property lawyer in your locality and show him all the property papers available to you, to get a real-time opinion on the matter and take steps accordingly to navigate the complex situation in the right way.
