A.Dear Client,
Whether the parents are separated or divorced, the children will be considered class I legal heirs of their biological parents and will have the right to inherit their self-acquired (unless specified otherwise in a will) and ancestral property. As per the Hindu law of inheritance, an ancestral property can be gifted/disposed of only under certain situations like distress or for pious reasons. Otherwise, the ancestral property cannot be given away or disposed of to others excluding all other legal heirs/coparceners who have the right to inherit the said property by birth.
