First of all..Thank you sir for your guidance. I have query, yesterday charge Framed on me and my family in which my sister discharge and charged me u/s 377 ipc and on my father u/s 345 ipc. Advocate suggest to go in session court for appeal . What can be the relief we get? Is there any benefit to go in session court. their is no ground except, no time and date mention in complaint case and no police call and MLC IN FIR. THIS IS ONLY 3rd date in FIR case. Please advise.
A.Both the charges against you and your father are difficult to prove but as the FIR is registered you have to take anticipatory bail as there might be chances that you might be arrested on the next date so before the 3rd date comes get yourself anticipatory bail from a good lawyer you will have to pay a fine to the court which may vary from RS. 10,000/- to Rs. 40,000/- or with 2 or more sureties.
