I was serving as a clerk in a goverment bank and due to my acute sickness I took quite a large number of sick leaves. Owing to which my job was terminated. Now I wish to get an experience certificate for the time period I serve. Will I be getting any?

A.Dear Client,
Regardless of the reason behind the termination or cessation of employment, an employee deserves an experience certificate from his employer for the period he serves the employer and this rule is uniformly followed in all sectors of employment including public sector units. Termination on the grounds of prolonged sickness potentially has no adverse impact/effect on your service career. Once you apply to your Bank for the issue of an experience certificate, the Bank is dutybound to issue you an experience certificate for the period you render your service to the Bank failing which you may escalate your grievance before the Labour Commissioner/Asst. Labour Commissioner (Central) for a resolution in the matter.

A.Dear Client,

The issuance of an experience certificate depends on the policies and regulations of the government bank you were employed with. Generally, experience certificates are provided by employers to employees upon the termination of their employment, regardless of the reason for termination. However, the specific circumstances surrounding your sickness-related termination may be a factor.

Here are some steps you can take:

1. Contact Human Resources/Personnel Department:
Reach out to the HR or Personnel Department of the bank and formally request an experience certificate. Clearly explain the circumstances of your termination due to illness and express your need for the certificate.

2. Review Employment Policies:
Check the bank's employment policies or guidelines to understand the provisions related to the issuance of experience certificates. Some organizations have standard procedures for providing experience certificates to terminated employees.

3. Provide Supporting Documents:
If your sickness is well-documented and supported by medical certificates or records, share these documents with the HR department to substantiate your situation. This may help in understanding the context of your termination.

4. Negotiate Amicably:
Approach the matter in a polite and amicable manner. Explain the importance of the experience certificate for your future employment prospects and request their cooperation.

5. Seek Legal Advice if Necessary:
If the bank is unwilling to issue the experience certificate, you may want to consult with a legal professional to explore your rights and options. They can provide guidance based on the employment laws applicable in your jurisdiction.

Remember that the policies and practices may vary between organizations, and it's crucial to follow the specific procedures of the bank you worked for.
