Second wife can be entered in khatauni as legal heirs whereas legal wife alive and never divorced.
A.Dear Client,
Without a divorce decree from a competent court annulling a marriage, neither spouse can legally marry another person, violating Section 5(1) of the Hindu Marriage Act, 1955, rendering such a marriage void under Section 11 of the Act. Consequently, disputes or claims stemming from such a void marriage are inadmissible and cannot be maintained in law or in practice.

In the absence of a decree of divorce passed by a competent Court of law annulling a marriage, either spouse cannot remarry another man or woman, and such a marriage that violates the condition of Sec.5(1) of the Hindu Marriage Act, 1955 and termed as void marriage as per Sec.11 of the Act. Accordingly, any dispute or claim arising out of said void marriage is neither admissible nor maintainable either in law or in fact.
