A.Dear Client,

If you believe the management's actions are unjust and violate the terms of your employment, you can send a legal notice to the company. If you're considered a worker under the Industrial Dispute Act, 1947, you can lodge a complaint with the Labor Commissioner for unfair treatment. You can also claim your dues through Sec.33C(2) of the same Act in the Labor Court. However, if you're a Manager or Administrative Officer, you'll need to file a civil suit in the Civil Court for resolution.

A.Dear Client,
In the given scenario, If the action of the management appears to you arbitrary, unethical, and contrary to the terms of your employment, then serving a legal notice to the Company you can escalate your grievance/complaint on the grounds of victimization and unfair labour practices against the management before the concerned Labour Commissioner provided you are a workman as defined under Sec.2(s) of the Industrial Dispute Act, 1947 to redress of your grievance. Additionally, you can file an application under Sec.33C(2) of the I D Act, before the Labour Court claiming your dues from the employer. But, if you are holding the position of Manager or Administrative Officer in the Company, you have to file a civil suit before the Civil Court for desired relief in the matter.
