I have been working with an organization that has terminated my service with immediate effect with one-month of extra pay. After that I immediately joined the new company with in a week. But later my old company update my last working days as after month date. Now this shows a service overlap and my claims in EPF is getting rejected. Now the old organization has stopped operation so I can not get the date corrected. Whereas EPFO claims they still have that organization as operational in there system. How to deal with this.

A.Dear Client,
You need to rectify the discrepancy between the joining date and exit date of the company. If there is an overlap in the PF records it might show dual employment during the background verification. So, in this case, you need to approach the office of the Regional P F Commissioner and seek to resolve the anomaly between the joining date and exit date in EPF records. Further, you need to submit a joint declaration form, a form jointly signed by the employer and employee to rectify the details of the member in PF records. On the receipt of this declaration, the regional PF commissioner can correct the wrong information entered into the employees' PF accounts. If the employer refuses to sign the joint declaration or cooperate in that regard, a member of EPFO can file a complaint against them using the EPF i-Grievance Management System at www. https://epfigms.gov.in/. Thereby, you will be able to correct the details and overcome the problem of dual employment.

A.Dear Client,
Before joining another Company you are required to tender your resignation and to obtain a relieving letter from the earlier company that eventually caused the overlapping of service and unfortunately became a cause of rejection of a claim against EPF accumulation. A joint declaration form is used to correct Provident Fund (PF) member details. It is a combined form that the employee and employer jointly sign and submit to the regional PF commissioner to update the wrong information entered in the employees’ PF accounts. In the given situation, to resolve the issue of overlapping in the P F records of both employers, you need to approach the office of the Regional P F Commissioner who is the competent authority to resolve any anomaly arising out of the date of appointment and date of exit in EPF records When the previous company is still in operation as per the record, you should approach your previous employer for correction of overlapping of service certifying the JDF. In case the previous employer denies their statutory obligation, you can file a complaint online using the EPF i-Grievance Management System (www. https://epfigms.gov.in/) and also in offline mode to the concerned office of the Regional PF Commissioner to resolve the issue in the right way.
